Terms of service

Use of our service assumes acceptance of these terms, which may change at any time. Any changes will be posted here so please check this page from time to time.

Account categories
As of December 1st 2012, all customers' accounts will be classified as one of the following types:

  • Brookesia micra
  • Chameleon Standard
  • Gecko
  • Dragon - coming soon!

All existing accounts prior to December 1st 2012 fall under the 'Chameleon Standard' classification, unless otherwise agreed.

Open source software
Chameleon Websites uses ‘open source’ Content Management System (CMS) software for most client websites, which enables sites to be quickly and easily edited by logging in from a browser and using a simple word processor-type interface. We do not sell this software, but rather offer its installation, hosting and related services - such as help with content and adapting templates.

Our offering is designed to bring the benefits of using such software to those with little or no knowledge or interest in setting up an open source CMS themselves.

We believe the software is suitable for the intended use, and you’re welcome to check out the sites we prepared earlier using it. But we don’t make any specific guarantees about the software, and are not responsible for the addition or subtraction of any features in future versions. This is outside our control.

While we perform minor upgrades on an ongoing basis as part of the fees you pay to us, please bear in mind we may need to make more significant upgrades in the future, which might involve switching your site to a different template to work the new software version. These new versions are generally introduced to meet security concerns and introduce new features. This process could affect how your site looks and the performance of any third party 'add-ons' or extensions, (for example image sliders). This type of upgrade would be likely every two to three years, but the exact timescale isn't possible to predict.  We'll consult with you first if we need to change your site's template for this reason. For Chameleon Standard customers, these periodic significant upgrades are included within their package.

Upgrades to Gecko and Dragon accounts are chargeable depending on your particular site's architecture and content.

Website designs
As of December 1st 2012, all new website designs (otherwise known as 'templates' or 'themes'), remain the property of Chameleon Websites;  these designs are leased to clients and remain the property of Chameleon Websites. Unless specifically agreed this includes new website designs created by us to work under new versions of the CMS, when previously designs by third parties may have been used.

If you wish to terminate your account with us you can purchase a non-exclusive licence to use the template design leased by us in use on your website for a one-off fee of £400.  This fee covers supply of the website design template only – see 'Cancellation' below for details about other files.

Placing your text and pictures on your site
The whole point of your website is that it gives you the power to publish. While we're happy to copy and paste your supplied text onto your new website, and re-size and reduce the resolution of the agreed number of photographs on to your pages if they are supplied at the time we create your site, where no text is made available we will insert dummy text to show the styles. It is then your responsibility to log in and replace this with the real text when you are ready. Similarly if you want us to process, upload and insert images or even design further graphics at a later stage, this work will be charged at our hourly rate.

Where the formatting of supplied text is particularly complex - for example multiple levels of headings, a significant number and/or level of bullet points etc - then we reserve the right to simply paste this as plain text and let you style it how you wish once you are given your login credentials.

Payment
We reserve the right to suspend service without notice on any account that is overdue. Payment is due annually in advance unless otherwise agreed. Generally PDF invoices will be sent by email, and wherever possible should be settled by BACS within 14 days of invoice date.

Cancellation
The minimum order period is one year, payable in advance unless otherwise agreed. Accounts over one year may be cancelled if notice is given in writing/by email, giving at least three month's notice. All payments must be up to date for a cancellation to be accepted. Refunds will be made where applicable, for time that has been paid for but is not required, beyond the period of notice. Following cancellation we reserve the right to delete all files, email forwarders etc pertaining to an account and are under no obligation to pass these over to clients or former clients.  

Uptime
We don’t make any guarantees about the ‘uptime’ of client sites, although it’s our aim to have sites up and running all the time. So far we’ve had no complaints.

Domains
If you register your own domain then it is your responsibility to renew it when this becomes necessary. If you don't, your site will stop working - or worse, someone might scoop 'your' domain from you. Your 'registrar' - the company where you bought it - should send you at least one reminder to renew by email. If we manage a domain for you then we will also renew it when the time comes.

Backups
Keeping a backup of your site’s content (your text and pictures) is your responsibility. We suggest you edit your pages in a basic text editor like Notebook, TextEdit or similar programme, and then copy and paste it into the CMS text editor when you’re ready, keeping a copy on your local machine (and ideally a copy elsewhere too as part of your backup strategy). We take reasonable steps to back up client sites as a customer courtesy but cannot test, and therefore can’t guarantee the integrity of, these backups. See also ‘hacking’ below.

Clients' own Terms of Use
It's up to you to include your own Terms of Use, Privacy Policies and any other legal information  on your website(s) as required under relevant laws.

Hacking
We can’t guarantee your site against hacking attempts. In the event of a site being hacked or failing in any other way we will do our best to restore it – or, in the worst case, build a new one - as soon as we can. However we do not guarantee to do this immediately. Please also see ‘Backups’ regarding keeping copies of your content on your local machine.

Email
The standard Chameleon Websites package forwards all mail, including any spam you may receive, to your specified address (eg This e-mail address is being protected from spambots. You need JavaScript enabled to view it or This e-mail address is being protected from spambots. You need JavaScript enabled to view it ). We can activate Spam Assassin software so any suspected spam is labelled as such, to make it easier for your to filter.

Unfortunately we are no longer able to forward mail in this way to Yahoo accounts so if you use Yahoo please contact us to discuss other arrangements. We also reserve the right to decline to forward to any other email host at our discretion.

If you need email arrangements other than email forwarding, please contact us to discuss your requirements.

Please bear in mind that, much as we’d love to, we do not support setting up email software, webmail etc on your own computer. There are lots of systems in use so it’s always best to consult the documentation with your particular programme and / or search for advice on the internet.

Spam - incoming
We cannot guarantee that you won't receive spam via your website contact form. There are measures that can be taken to potentially reduce it should it become a problem - see the client-only FAQs for details.


Spam - outgoing
We take a zero tolerance stance against sending of unsolicited email, bulk emailing and spam using our servers. Most customers don’t use our servers for sending email, but rather that of their own Internet Service or webmail provider (see above). But if you have made other arrangements with us and intend to do any of the above using our servers, please speak to us first so we can offer more information about what is and isn’t acceptable.

The bottom line is: any user who sends out spam using our email facilities will have their account terminated with or without notice.

Support of software on your computer
We don’t support any software that runs on your own computer, such as setting up email software, webmail, operating systems, browsers, word processors etc etc. Sorry – that’s not what we do.

Content
It’s your responsibility to ensure content on your website is legal, honest and truthful, and does not breach any relevant advertising standards, or distance selling guidelines or similar. Similarly content must not be defamatory. You may not place inappropriate, potentially offensive or criminal material on your site. This includes unlawful, harassing or 'flaming', defamatory, abusive, threatening, harmful, obscene, profane, sexually orientated, racially offensive or otherwise objectionable material. We reserve the right to remove any material or suspend or terminate any account without notice or explanation that in our view breaches these terms .You warrant that you have the right to post any material contained on your website, and that your contributions are not defamatory, and that they do not infringe any law including that of copyright. You indemnify Chameleon Websites against all legal fees, damages and other expenses that may be incurred as a result of your breach of this warranty or your use of your website in general. We reserve the right to remove with or without notice, and withdraw service, to any customer we believe contravenes these 'content' requirements.

Search Engines
We do not, and cannot guarantee that your site will show up in the search results of any search engine. This is because we control neither the criteria the search engines use to rank sites, nor the many sites yours will probably be competing with. Any 'Search Engine Optimisation' services are offered without any guarantee, as we are unable to directly control the behaviour of search engines or competitors’ websites.

Changes to the TOS
Chameleon Websites reserves the right to revise its policies at any time without notice.
